On Tuesday, 5th November, the Tobacco and Vapes Bill was introduced to the House of Commons and underwent its First Reading. This stage is largely procedural and occurs without any debate. The next step is the Second Reading, during which MPs will discuss the Bill, though the date for this has yet to be announced.

Below is Aquavape's initial summary of key points from the Tobacco and Vapes Bill. Please note that this is a high-level overview based on the first review of the Bill, which is over 100 pages long.

Key Provisions of the Tobacco and Vapes Bill

As primary legislation, the Bill proposes the following powers:

  • Prohibiting the sale and free distribution of vaping and nicotine products to individuals under 18.
  • Banning out-of-home advertising, such as on public transport, posters, billboards, printed leaflets, and sponsorship agreements for vaping and nicotine products.
  • Introducing regulations for flavours, packaging, and other product standards for vapes and nicotine products.
  • Granting powers to control the display of vapes and nicotine products.
  • Banning vending machines for vape and nicotine product sales.
  • Replacing the current MHRA Notification with a new registration scheme for vapes, nicotine products, and tobacco products.
  • Establishing a retail licensing scheme for vapes.
  • Extending smoke-free laws to potentially prohibit vaping and the use of heated tobacco products in areas where smoking is already banned.

Implementation Timelines

According to the Impact Assessment published alongside the Bill, the following timelines apply:

  • 2027: Restrictions on advertising, sponsorship agreements, and point-of-sale displays for vaping and nicotine products will take effect.
  • 2026: The ban on vending machine sales of vaping and nicotine products will come into force six months after the Bill receives Royal Assent.
  • 2027: Regulations concerning product flavours, packaging, and presentation will also come into effect.
